This Dispute Resolution & Governing Law Policy is subject to and incorporated into the Shwcse Vendor Terms of Use. In the event of any conflict, the Vendor Terms of Use control.
1. Informal Resolution
Vendors agree to first attempt to resolve any disputes, claims, or controversies arising out of or related to their participation on the Shwcse platform by contacting Shwcse Support.
Most disputes can be resolved efficiently through informal communication.
2. Binding Arbitration
Except where prohibited by law, any dispute that cannot be resolved informally shall be resolved through binding arbitration rather than in court.
Arbitration shall be conducted on an individual basis. Vendors waive the right to participate in class actions, class arbitrations, or representative proceedings.
3. Arbitration Location & Rules
Arbitration shall be conducted in accordance with applicable arbitration rules, with the location and procedures determined by Shwcse unless otherwise required by law.
4. Governing Law
This policy and any disputes arising from vendor participation shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict of law principles.
5. Injunctive Relief
Nothing in this policy prevents Shwcse from seeking injunctive or equitable relief in a court of competent jurisdiction to protect its intellectual property, confidential information, or platform integrity.
6. Limitation on Claims
Any claims must be brought within the time limits permitted by applicable law. Failure to do so may result in waiver of the claim.
7. Policy Updates
Shwcse may update this Dispute Resolution & Governing Law Policy at any time. Continued participation as a vendor constitutes acceptance of the most current version.
