These Customer Terms of Use (“Terms”) govern your access to and use of the Shwcse website, mobile applications, and related services (collectively, the “Platform”).
By accessing or using Shwcse, you agree to these Terms. If you do not agree, do not use the Platform.
1. What Shwcse Is
Shwcse is an online marketplace that connects customers with independent brands and sellers. Unless explicitly stated otherwise, Shwcse is not the seller, manufacturer, or retailer of products listed on the Platform.
Products are sold and fulfilled by third-party sellers.
2. Eligibility
To use Shwcse, you must:
Be at least 18 years old (or the age of majority in your jurisdiction)
Have the legal ability to enter into a binding agreement
By using the Platform, you confirm you meet these requirements.
3. Accounts & Security
You may be required to create an account to place orders.
You are responsible for:
Keeping your login credentials secure
All activity that occurs under your account
Providing accurate contact and delivery information
Shwcse is not responsible for unauthorized account use.
4. Orders & Payments
All orders must be paid in full at checkout.
Payments are processed through a third-party payment processor (Stripe). Shwcse does not act as a bank, escrow service, or fiduciary and does not hold customer funds.
Placing an order does not make Shwcse the seller or merchant of record.
5. Pricing & Availability
Prices, availability, and product descriptions are set by sellers and may change at any time.
Shwcse reserves the right to cancel orders due to inventory issues, suspected fraud, or operational limitations.
6. Delivery
Orders may be delivered by independent third-party delivery partners.
Delivery times are estimates only and not guaranteed. Responsibility for the order transfers to the customer once delivery is confirmed.
Delivery issues are governed by Shwcse’s Delivery Policy and Lost / Stolen Delivery Policy.
7. Returns, Refunds & Cancellations
Because Shwcse works with independent sellers, all sales are final unless otherwise stated.

Submitting a request does not guarantee approval.
8. Product Use & Safety
Customers are responsible for reviewing product details, ingredients, sizing, and usage instructions before purchase or use.
Health, safety, and product-related risks are governed by the Product Disclaimer & Health & Safety Policy.
9. Acceptable Use
You agree not to:
Use the Platform for unlawful purposes
Engage in fraud, refund abuse, or chargeback misuse
Harass sellers, delivery partners, or Shwcse staff
Attempt to manipulate Platform systems or policies
Violations may result in account suspension or termination without notice.
10. Marketplace Liability
Shwcse provides the Platform on an “as-is” and “as-available” basis.
Seller obligations, dispute handling, and liability limitations are governed by the Marketplace Liability Disclaimer, which is incorporated into these Terms.
11. Intellectual Property
All Platform content, trademarks, and technology are owned by or licensed to Shwcse. You may not copy, modify, or use Platform content without permission.
Seller content remains the property of its respective owner.
12. Disclaimers
Shwcse makes no guarantees regarding:
Product quality or results
Seller performance
Delivery outcomes
All warranties are disclaimed to the fullest extent permitted by law.
13. Limitation of Liability
To the maximum extent permitted by law:
Shwcse is not liable for indirect, incidental, or consequential damages
Shwcse’s total liability will not exceed the amount you paid for the applicable order
14. Indemnification
You agree to indemnify and hold harmless Shwcse and its affiliates from claims arising out of:
Your use of the Platform
Transactions with sellers
Violations of these Terms
15. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles.
Any disputes arising out of or relating to these Terms or use of the Platform shall be resolved exclusively in the state or federal courts located in Fulton County, Georgia.
16. Changes to These Terms
Shwcse may update these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.
