1. Role of Shwcse
Shwcse operates as an online marketplace that connects customers with independent brands and sellers. Unless explicitly stated otherwise, Shwcse is not the seller, manufacturer, distributor, or retailer of products listed on the platform.
All products are offered and sold directly by third-party sellers.
2. Payments & Transaction Facilitation
Shwcse facilitates payments between customers and sellers through a third-party payment processor (Stripe).
Shwcse does not act as a bank, escrow service, trustee, or fiduciary and does not hold customer funds on behalf of sellers. Payment facilitation does not make Shwcse the merchant of record or responsible for seller obligations.
3. Seller Responsibility
Each seller is solely responsible for:
Product descriptions, pricing, and availability
Product quality, safety, labeling, and legal compliance
Order preparation and fulfillment
Any warranties, guarantees, or representations
Shwcse does not independently verify, endorse, or guarantee seller listings or claims.
4. No Guarantee of Seller Performance
Shwcse does not guarantee that:
Sellers will fulfill orders without issue
Products will meet customer expectations
Sellers will comply with all applicable laws or standards
Use of the platform and purchases from sellers are at the customer’s own risk.
5. Disputes & Claims
Disputes related to:
Product quality or performance
Seller conduct or accuracy
Order fulfillment issues
are primarily between the customer and the seller.
Certain disputes, including payment disputes or chargebacks, may be processed through Shwcse’s payment processor or financial institutions in accordance with their policies. Shwcse may assist with dispute resolution at its discretion but does not guarantee outcomes and is not responsible for decisions made by third parties.
6. Limitation of Liability
To the fullest extent permitted by law:
Shwcse shall not be liable for indirect, incidental, special, or consequential damages
Shwcse’s total liability related to any transaction shall not exceed the amount paid by the customer for the applicable order
7. Release & Indemnification
By using Shwcse, customers agree to release, defend, indemnify, and hold harmless Shwcse, its affiliates, officers, employees, contractors, and partners from claims, damages, losses, or expenses arising from:
Use of the platform
Transactions with third-party sellers
Disputes or interactions with sellers
